DMCA Policy

Last updated: October 2026

1. Our Commitment to Copyright Protection

Realty Wave was built by a content creator, for content creators. We take copyright protection seriously because we understand what it means to have your work stolen.

Realty Wave acts on every valid takedown notice. We track repeat infringement and apply the three-strike process in section 6.

We comply fully with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. Section 512, and have designated an agent to receive notifications of claimed infringement.

IP addresses and email addresses are logged on every upload. We respond to valid notices, act on repeat infringement as described below, and cooperate with lawful requests for information. Whether any infringement is pursued in court is a matter for the rights holder and the authorities, not for us.

2. Filing a DMCA Takedown Notice

If you believe that content hosted on the Realty Wave platform infringes your copyright, you may submit a written notification to our designated DMCA agent containing the following elements, as required by 17 U.S.C. Section 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by a single notification, a representative list)
  3. Identification of the material that is claimed to be infringing and that is to be removed, including information reasonably sufficient to permit us to locate the material (e.g., the content URL, experience name, or content title on the Platform)
  4. Your contact information, including your address, telephone number, and email address
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

3. Designated DMCA Agent

Realty Wave is operated by Imagine Peak LLC, which also operates Harmonic Wave. Our designated agent is registered with the U.S. Copyright Office's DMCA Designated Agent Directory under the Harmonic Wave service.

Registration Number: DMCA-1071290

Send all DMCA takedown notices to:

Designated Agent: Imagine Peak LLC
8051 N Tamiami Trail Ste E6
Sarasota, FL 34243
Phone: (941) 318-1136
Email: legal@imaginepeak.com

4. What Happens When We Receive a Notice

Upon receiving a valid DMCA takedown notice, we will:

  1. Remove or disable access to the allegedly infringing content promptly
  2. Notify the uploader that their content has been removed and provide them with a copy of the takedown notice
  3. Record a strike against the uploader's account (see Repeat Infringer Policy below)
  4. Preserve the audit record of the takedown and of any counter-notice action, for legal compliance. That record is not tied to your account and is not removed when you delete your account, which is an exception to the deletion described in our Privacy Policy. The content itself, its upload metadata, and any counter-notice you filed are removed with your account
  5. Share each notice with the other side. As our practice, we give the uploader a copy of the takedown notice, including the complainant's name and contact details, so they can judge whether to respond. The statute requires us to notify them of the removal; providing the full notice is our choice. Forwarding a compliant counter-notice to the complainant, including the uploader's name, mailing address and phone number, IS required by 17 U.S.C. Section 512(g). Neither side can file while keeping those details private

5. Counter-Notification Process

If you believe your content was removed in error or that you have authorization to use the material, you may file a counter-notification containing:

  1. Your physical or electronic signature
  2. Identification of the content that was removed and the location at which it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement that you consent to the jurisdiction of the federal court in your judicial district (or, if outside the United States, any judicial district in which Realty Wave may be found), and that you will accept service of process from the person who provided the original takedown notice, or from that person's agent

Send counter-notifications to the same DMCA Agent address listed above with the subject line "DMCA Counter-Notification."

Upon receiving a valid counter-notification, we will:

  1. Forward the counter-notification to the original complainant
  2. Inform the complainant that the removed content will be restored in 10 business days unless we receive notice that the complainant has filed a court action
  3. Restore the content within 10 to 14 business days following receipt of a valid counter-notice, unless we receive notice of a filed court action seeking to restrain the infringement
  4. Remove the associated strike from the uploader's account if the content is restored

6. Repeat Infringer Policy

Realty Wave maintains a strict repeat infringer policy with a three-strike system. The table describes what happens automatically. Anything beyond it, including permanent termination or removal of content that was not itself the subject of a notice, is a decision we take case by case after review rather than an automatic consequence.

Strike Action
First strike Content removed. Written warning issued. Strike recorded on account.
Second strike Content removed. Final warning issued. Strike recorded on account.
Third strike Account suspended automatically. API keys and sessions revoked, ending access to the Platform and its API.

Strikes are tracked by account email address. Creating a new account to circumvent a ban is a violation of our Terms of Service and may result in additional legal action.

Strikes that are reversed through a successful counter-notification are removed from the user's record.

7. Good Faith Requirement

Both takedown notices and counter-notifications include statements made under penalty of perjury.

Under 17 U.S.C. Section 512(f), anyone who knowingly materially misrepresents that material is infringing, or that it was removed by mistake or misidentification, is liable for the damages that misrepresentation causes, including costs and attorneys' fees, to the injured party and to us. That is a civil liability created by the statute, and it is not the same as a criminal prosecution. We do not claim otherwise.

If you are unsure whether content on the Platform infringes your copyright, we strongly recommend consulting an attorney before filing a notice.

Realty Wave reserves the right to disregard notices or counter-notifications that do not substantially comply with the requirements of the DMCA.

8. Contact for DMCA Notices

All DMCA notices, counter-notifications and related communications must go to our designated agent:

legal@imaginepeak.com

This is the same designated-agent address given in section 3. A notice sent elsewhere may not reach the agent and may not be treated as received.

For general questions about our copyright policies, see our Terms of Service or contact us at the address above.
