1. Acceptance of Terms
By accessing or using the Realty Wave platform ("Platform"), including our website at realtywave.ai, our API, our MCP (Model Context Protocol) server, or any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
These Terms constitute a legally binding agreement between you and Imagine Peak LLC dba Imagine Peak Studios, the operator of Realty Wave ("we," "us," or "our"). Realty Wave runs on the Harmonic Wave platform, which we also operate, so accounts, content, the API, the MCP server and connected services work the same way on both. We may update these Terms at any time, and your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
2. Account Registration
To access certain features of the Platform, you must create an account. Account creation requires a valid email address and is completed through our passwordless authentication system (email verification codes).
You agree to:
- Provide accurate and current information
- Maintain the security of your API key(s)
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activity that occurs under your account
2.1 Account Types
Creator accounts are for individuals and organizations that publish content and build experiences on the Platform. Creators have access to content management, experience building, profile customization, and the full suite of MCP tools.
Developer accounts are for individuals and organizations that build agents and applications that deliver experiences to end users. Developers have access to API keys, documentation, and consumption-oriented MCP tools.
Account type is determined during onboarding and may be changed by contacting us. Platform access is by invitation; selected clients may receive early access during a production project.
3. Content Ownership
You retain all rights, title, and interest in and to the content you upload to the Platform. Realty Wave does not claim ownership of your content at any time, under any circumstances.
We believe creators should always own their work. The Platform is a tool for structuring and delivering your content, not a mechanism for acquiring rights to it.
4. Content License Grant
By uploading content to the Platform, you grant Realty Wave a limited, non-exclusive, worldwide license to:
- Host, store, and cache your content on our infrastructure
- Stream and deliver your content to authorized users and AI agents
- Generate thumbnails, waveforms, and previews for display purposes
- Transcode or optimize media for delivery performance
- Transmit your content, and finished works made from it, to a third-party service you have connected and instructed us to publish to, such as a YouTube channel
- Create and store encrypted delivery copies of your content, and decrypt those copies to provide authorized playback or viewing
This license exists solely to operate the Platform and deliver your content as you direct. This Platform license terminates when you delete your content from the Platform. Separate permissions granted in a written production agreement for an approved finished work and its promotional excerpts continue only as that agreement provides; they do not permit unrelated use of the standalone song or of the listing photographs, property videos, floor plans, or other materials you supplied.
Publication to a connected service happens only on your explicit instruction for the specific work you name. Connecting an account is not that instruction. Once a work is published there, it exists as a separate copy on that service, governed by your relationship with it, and deleting your content here does not remove it.
Your content is never used for AI model training. We do not use, license, sell, or otherwise provide your content to any third party for the purpose of training machine learning models, large language models, or any form of artificial intelligence system.
5. Platform-Generated Assets
Separately from content you upload, the Platform can generate media assets for you using AI tools, for example, synthetic presenter portraits, cover and poster art, banners, and voices (“Platform-Generated Assets”). This section governs Platform-Generated Assets only. It does not affect your rights in the content you upload, which are addressed in Sections 3 and 4, that content remains yours. Nor does it affect your ownership of finished masters the Platform produces for you, which is addressed below, those are yours too.
- Ownership of the original. Realty Wave creates and owns the original Platform-Generated Asset, the source, full-resolution file it produces and stores, and controls that original and its availability across the Platform. Platform-Generated Assets are licensed to you, not sold.
- No copyright monopoly claimed. Platform-Generated Assets are produced with third-party AI tools, may not be unique (identical or similar assets may be generated for or provided to others), and purely AI-generated material may not be eligible for copyright protection. If someone independently creates, copies, or screenshots a similar image, that copy is not the original asset Realty Wave generated and conveys no rights in it.
- License to use (all plans). When you use a Platform-Generated Asset, Realty Wave grants you a limited, non-exclusive, revocable, non-transferable license to use that asset within the Platform in connection with your account. You do not acquire ownership of the standalone asset by using, selecting, or assigning it to a profile or experience. This in-Platform license is separate from, and weaker than, the license that travels with a finished master below, which is perpetual and irrevocable.
- Shared pool and recirculation. Platform-Generated Assets may be drawn from and returned to a shared pool. If you stop using an asset, for example by replacing it, or by deleting the profile or experience it was assigned to, your in-Platform assignment license to it ends and Realty Wave may make that asset available to other users. This ends only that assignment. It does not affect masters you already own or generated media you already received, whose licenses are permanent and are described below. Synthetic presenter personas are not intended to depict any real individual.
- No exclusive ownership. Platform-Generated Assets are licensed, not sold, and remain owned by Realty Wave. These Terms grant no option to acquire an asset or reserve it for your exclusive use.
- You own your finished masters. A finished master is a completed work the Platform produces for you and that you take out of it, such as a rendered experience, video, or audio file. You own it. Realty Wave claims no ownership of your masters, and that does not change if you later replace an asset, delete an experience, disconnect a channel, or close your account.
Where a master contains a Platform-Generated Asset, you have a perpetual, irrevocable, worldwide license to use that asset as part of that master, for any purpose including commercial use, distribution, publication and monetization, on any service. That license cannot be revoked and does not expire. Anything already published stays published, and you can keep distributing the master afterwards. - Generated media you receive is yours to use, including outside the Platform. Where the Platform generates media for your work, video, audio, artwork and similar output, you have a perpetual, irrevocable, worldwide license to use it, and that license is not limited to the Platform. You may download it, edit and remix it, build new works from it, publish it anywhere, and monetize it. Replacing an asset, deleting an experience, or closing your account does not take that away or oblige you to stop using what you already have.
- The Hosts are not yours. Realty Wave's synthetic presenters, their identity, likeness, portraits, voice, and the assets built around them such as sets, angles, and marketing imagery, are core intellectual property of the Platform. They are licensed to you, never sold or assigned, and this is the one place the licenses above stop.
What you DO have is permanent: a Host appearing inside a master or a generated media file you already hold is licensed to you perpetually and irrevocably as part of that work, so anything you have published or downloaded is safe forever and you may keep distributing and monetizing it.
What you do NOT have is the Host itself. You may not extract or recreate a Host's likeness or voice to make a new presenter, use a Host as a brand, mascot, spokesperson or endorser outside the work it was generated for, or license or transfer it onward.
Hosts may not be trained on. You may not train or fine-tune any model on a Host, its likeness, or its voice.
This is a different subject from Section 13. Section 13 is a promise about what we and our providers do with your content: it is never used to train models. This bullet governs what you may do with Host material we licensed to you. Neither weakens the other. - Provenance. Platform-Generated Assets may carry embedded provenance signals (such as invisible AI watermarks) indicating they were produced by AI. You agree not to remove, obscure, or falsify these signals.
6. Prohibited Content
Realty Wave enforces a ZERO TOLERANCE policy for the following. Violations result in immediate account termination, content removal, and referral to law enforcement where applicable.
You may not upload, publish, or distribute content that:
- Pornography or sexually explicit material: Content depicting explicit sexual acts, nudity intended to arouse, or any sexually exploitative material
- Child sexual abuse material (CSAM): Any content depicting, suggesting, or involving the sexual exploitation of minors. This is reported to NCMEC and law enforcement immediately upon discovery
- Content involving minors in any harmful context: Any content that endangers, exploits, or depicts minors in inappropriate situations
- Illegal content: Content that violates applicable law, including but not limited to content promoting terrorism, inciting violence, facilitating illegal drug sales, or distributing malware
- Defamatory or harassing content: Content targeting individuals with threats, harassment, doxxing, or false statements of fact
We log IP addresses and email addresses on all uploads, and we cooperate with lawful requests for information. Whether any violation is pursued in court is a matter for the rights holder and the authorities, not for us.
Copyright-infringing content, meaning content for which you do not hold the necessary rights or licenses, is also prohibited. It is handled under the three-strike process in Section 9 and our DMCA Policy, not the immediate termination above: a third valid strike suspends the account automatically, and anything beyond that is decided case by case after review.
7. Upload Requirements
When uploading content to the Platform, you represent and warrant that:
- You own or have obtained all necessary rights, licenses, and permissions for the content
- The content does not infringe any third party's intellectual property rights, privacy rights, or publicity rights
- You have accurately rated and described the content
- The content complies with all applicable laws and these Terms
Uploads are subject to automated validation (file type, file size, magic byte verification) and may be subject to additional review. We reserve the right to remove any content that violates these Terms.
8. Advertising & Commercial Content
Realty Wave is an ad-free platform by design.
We do not serve third-party advertising, insert interruptions, or monetize user attention through ad-based models.
Creators may not include advertising, sponsorships, or promotional content within experiences without prior written approval from Realty Wave.
Promoting a property, an area, or a broker, agent, or brokerage is part of what Realty Wave produces. That promotion is permitted when it is part of an approved production or is otherwise approved by Realty Wave in writing, and it must comply with the real estate advertising and fair housing rules that apply to it. The restrictions below continue to apply to all other advertising, sponsorship, and promotional content.
This includes, but is not limited to:
- Paid promotions or sponsored segments
- Affiliate links or referral marketing
- Branded integrations or product placements
- Promotional messaging for third-party products or services
All experiences on Realty Wave are intended to preserve narrative flow, audience trust, and creator-defined intent. Advertising disrupts this model and is therefore restricted.
Realty Wave may remove or disable any experience that includes unauthorized advertising or promotional content, and may suspend or terminate accounts for repeated violations.
We may introduce curated, platform-approved commercial models in the future, but all experiences will remain free from intrusive or unstructured advertising.
Realty Wave is designed as a premium, ad-free platform for both creators and audiences.
This promise covers experiences delivered by Realty Wave. It does not and cannot extend to other services. If you publish a work to a connected channel, that service controls advertising on its own platform: YouTube may run advertising against your video there regardless of anything in this section, and its rules, not ours, govern that. The restrictions above on advertising and promotional content inside experiences continue to apply to experiences delivered here.
Publishing or promotional work for a production project must be separately scoped and authorized in writing. It does not follow automatically from uploading content or connecting a channel. Any media management fees and ad spend must be agreed separately; see Section 25.
9. DMCA Compliance
Realty Wave respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). If you believe content on the Platform infringes your copyright, please see our DMCA Policy for instructions on filing a takedown notice.
We maintain a repeat infringer policy. A third valid DMCA strike automatically suspends the account and revokes its API keys and sessions, ending access to the Platform. Permanent termination, and removal of content that was not itself the subject of a notice, are decisions we take case by case after review rather than automatic consequences. The DMCA Policy sets out the full three-strike table.
10. API Usage and Rate Limits
Access to the Platform API and MCP server is governed by your account plan (Free, Pro, or Enterprise). Each plan includes specific rate limits, storage quotas, and feature access levels.
You agree not to:
- Exceed your plan's rate limits or attempt to circumvent rate limiting
- Use the API for any purpose not intended by the Platform
- Share API keys with unauthorized parties
- Reverse-engineer, decompile, or disassemble any part of the Platform
- Use automated systems to scrape, crawl, or extract data from the Platform beyond normal API usage
- Use the Platform in a manner that imposes excessive load, disrupts service integrity, or degrades performance for other users
11. Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion:
- Violates these Terms or any applicable law
- Is harmful to other users, third parties, or the Platform
- Involves fraudulent, abusive, or illegal activity
You may delete your account at any time through the Platform (via the delete_account MCP tool or dashboard). Account deletion permanently removes your associated data, content, API keys, and access records, with the following exceptions you should know about.
- An outstanding permission withdrawal. If you had connected a YouTube channel and a withdrawal of that permission has not yet been confirmed, the encrypted credential needed to complete it survives the deletion for no more than seven days, is used for nothing else, and is then erased whether or not it succeeded. A record that the withdrawal was requested and not confirmed remains, holding no credential and no channel details. See section 7.2 of the Privacy Policy.
- Anything already published elsewhere. Deleting your account does not remove videos already published to a YouTube channel. Only you can take those down, on YouTube.
- DMCA audit records. Where a takedown or counter-notice action was taken on your content, the record of that action is retained for legal compliance and is not removed with your account. See our DMCA Policy and Privacy Policy section 8.
12. Intellectual Property
Realty Wave runs on the Harmonic Wave platform. The platform, including its technology, architecture, user interface, documentation, and brand assets, and the Realty Wave name, logo and brand assets, are our intellectual property.
The Harmonic Wave platform is patent pending under U.S. Provisional Application No. 64/025,205 & 64/037,590. HARMONIC WAVE® is a registered service mark, U.S. Registration No. 8,450,726, registered September 22, 2026 in International Classes 038, 041 and 042. The "Harmonic Wave" name and logo are registered trademarks.
Nothing in these Terms grants you any right to use our trademarks, brand assets, or proprietary technology beyond normal use of the Platform as a customer.
13. No AI Training
Content uploaded to Realty Wave is not used for training artificial intelligence models under any circumstances. This applies to:
- Large language models (LLMs)
- Image generation models
- Audio synthesis models
- Any other machine learning system
Your content is stored, delivered, and streamed, never fed into training pipelines. This is a core principle of the Platform, not merely a policy choice.
14. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Realty Wave shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of (or inability to access or use) the Platform
- Any conduct or content of any third party on the Platform
- Any content obtained from the Platform
- Unauthorized access, use, or alteration of your content or data
Our total aggregate liability for all claims related to the Platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising out of or relating to these Terms or the Platform shall be resolved in the federal or state courts of competent jurisdiction within the United States.
17. Changes to These Terms
We may revise these Terms at any time to reflect changes in the Platform, its usage, business practices, or market conditions.
Updated Terms will be posted on this page with a revised “Last updated” date. For material changes, we may provide notice via email or through the Platform.
By continuing to access or use the Platform after updated Terms are posted, you agree to be bound by the revised Terms.
This does not extend to connected accounts. Continued use is never treated as permission to access additional data from a connected Google or YouTube account, or to use data already obtained from one for a new purpose. Either requires a fresh authorization from you at the time, and revising these Terms does not provide it.
18. Experience Generation and Delivery
Experiences on Realty Wave may be generated or delivered dynamically through AI agents and automated systems.
While the Platform provides structured data and delivery instructions, Realty Wave does not guarantee that all experiences will be rendered or interpreted exactly as intended across all agents, applications, or environments.
Creators are responsible for reviewing and validating their experiences. Realty Wave is not liable for variations in presentation, sequencing, or interpretation by third-party systems.
19. Third-Party Agents and Applications
The Platform may be accessed or used through third-party AI agents, applications, or integrations.
Realty Wave does not control and is not responsible for the behavior, output, or interpretation of content by third-party systems.
Use of third-party agents is at your own risk and subject to the terms of those providers.
An agent you authorize with an API key can read the content and experience data that key permits. That is sharing you initiated, and issuing and revoking keys is how you control it. Credentials the Platform holds on your behalf, including connected-account tokens, are never available to an agent through any interface.
20. Experience Schema Usage
The Harmonic Wave Experience Schema (HWES) may be publicly documented and accessible.
Use of the schema does not grant any rights to the underlying Harmonic Wave platform, infrastructure, or proprietary systems.
Realty Wave reserves all rights to the implementation, delivery mechanisms, and related technologies supporting the Platform.
21. Pricing and Service Model
Realty Wave reserves the right to modify pricing, features, usage limits, and service tiers at any time based on platform usage, operational considerations, and market conditions.
Changes may include adjustments to storage, API usage, feature access, or other aspects of the Platform.
22. Content Access and Delivery
Content on Realty Wave is delivered through controlled, proxied access mechanisms.
Users may not attempt to bypass, extract, or persist media outside of authorized delivery methods.
Exporting your own finished work, and publishing it to a service you have connected and instructed us to publish to, are authorized delivery methods. This section restricts circumvention of access controls, not your use of your own content through routes the Platform provides.
Encrypted playback and viewing. Where enabled for supported content, Realty Wave uses encrypted delivery to help protect media you share from casual downloading and copying. Downloading the encrypted delivery file alone does not provide a playable or viewable copy.
These measures do not guarantee that shared content cannot be recorded, captured, extracted, or copied. Protection differs by content type and delivery method. Authorized downloads and copies published to other services are outside these protections.
You control sharing and the available download settings. These measures do not change your ownership or your rights to download, export, publish, or use your own content and finished works through authorized methods.
Except where permitted by applicable law or expressly authorized by us, you may not bypass delivery controls, extract or redistribute playback keys, or obtain media copies outside authorized delivery methods.
Withdrawing access stops future authorized delivery. It cannot recall content or decryption information already received.
Realty Wave reserves the right to modify access controls, delivery mechanisms, and validation systems at any time.
23. Platform Evolution
Realty Wave is an evolving platform. Features, functionality, and system behavior may change as the Platform develops.
Users acknowledge that certain capabilities may be experimental, modified, or discontinued as part of ongoing development.
24. Connected Accounts and YouTube
The Platform can connect to third-party accounts that you authorize, including YouTube channels.
By connecting a YouTube channel you agree to the YouTube Terms of Service. Google's handling of any data it receives is governed by the Google Privacy Policy.
You authorize every connection yourself, on Google's own consent screen. Realty Wave asks for the narrowest permissions a feature needs, and does not act on a channel you have not connected.
Connecting a channel does not by itself permit us to publish to it. Publication happens only on your explicit instruction, for the specific content you name, and connecting or granting a permission is not that instruction.
You may disconnect a channel at any time from Settings, or revoke access directly at Google Account permissions. Revoking at Google may affect more than one permission granted to Realty Wave from the same Google Account.
You remain responsible for what is published to your channel through the Platform, and for that content complying with YouTube's policies and the law. Publishing through the Platform does not transfer that responsibility to Realty Wave.
A published video is a separate copy, on YouTube, under your control and not ours. Disconnecting the channel, deleting the source content on the Platform, or deleting your Platform account does not remove it. Rotating a Realty Wave share link does not affect it either. Taking it down is something only you can do, on YouTube.
Access to a connected channel depends on Google. Permissions can be withdrawn by you or by Google at any time, and features that rely on them will stop working until the channel is connected again.
25. Production Project Terms
Project agreement. A production engagement is governed by its written project agreement, including the agreed scope, deliverables, fees, revisions, and delivery schedule. If it differs from these Terms, that agreement controls the engagement. Receiving or signing a separate project agreement does not itself constitute acceptance of these Platform Terms. The production brief forms part of the agreed project scope.
Approval before release. You approve the creative direction before production and review the finished version before its first public release. Written approval may be given by email. Hosts, narration, and on-screen lyrics appear as agreed in the approved version. An unfinished or unapproved production will not be published. Payment, cancellation, and changes to scope are governed by the project agreement.
Your property, song and supplied materials. You retain your rights in the listing photographs, property videos, floor plans, property details, and other materials you supply, and in any composition, lyrics, recording, and artwork you supply. You must have authority to supply them for analysis, planning, and production, and confirm in writing before release that the permissions needed for the agreed publication, promotion, and monetization are in place. Any additional rights holder must be identified and their required consent obtained before release.
Finished work and Hosts. As between you and the Operator, you own the finished master delivered to you and may publish, distribute, clip, and monetize it worldwide. The permanent licenses in Section 5 apply to generated material and any Host embedded in that work. The Platform, its tools, production assets, and a Host’s identity, likeness, and voice remain with the Operator; a Host may not be extracted to create new performances independently.
Publication and promotion. Permission to use your production on Realty Wave channels, our website, social media, presentations, or in paid promotion must be expressly agreed in writing. This includes any permission to demonstrate or market the Platform. It does not allow use of your standalone song, or of the listing photographs, property videos, floor plans, or other materials you supplied, in an unrelated advertisement, another video, or another creator’s project. The duration of those permissions is set by the project agreement; a perpetual grant is not implied by using the Platform.
Music claims and credits. Producing the work does not itself give the Operator a share of your song royalties or authorized Content ID earnings. Where agreed publications are affected by music claims, you agree to work with your distributor or rights administrator to resolve claims that block or remove those publications. The Operator will not use the production to claim your own uploads. Credits, where the format supports them, identify the song and artist and the Realty Wave platform; a Host may also be credited if included.
Project-specific arrangements. A no-charge pilot, revenue arrangement, or permission concerning a particular property, listing, area, or song title applies only when expressly agreed for that project. It does not establish general pricing, a royalty share, or a transfer of either party’s music, property media, or brand rights.
26. Google Ads Connections
You may connect a Google Ads account you are authorized to access. Connecting grants access only to the features you authorize. It creates no campaigns, changes no campaign budgets, and spends nothing by itself.
Any campaign creation, activation, or changes require a separate authorized action. Paid media management and ad spend are scoped separately from production. You remain responsible for your Ads account, campaign settings, and charges.
Disconnecting withdraws the Platform’s access. It does not pause or stop campaigns already running in Google Ads. You must manage those campaigns in Google Ads. Our Privacy Policy describes the account data, encrypted credentials, reporting, and retention.
27. Listings, Area Pages and Examples
Listings, videos and briefs shown on Realty Wave are examples of our work, shown with the permission of the broker or agent involved. They are not offers to sell any property. Interiors may show builder model homes, and features, finishes, views and availability vary. Contact the listing agent for current details.
Area pages, such as Venice Beach Florida, describe a place for people thinking about moving there. Schools, drive times, prices, history and other details are general information that can change; confirm anything that matters to your decision with the source or a local real estate professional.
Hosts who appear in Realty Wave videos are AI hosts. Any resemblance of an AI host to a real person is coincidental.
